Agreement to terms

These Terms and Conditions ("Terms") govern your access to and use of the website and services offered by The Podcast Pad ("we," "us," or "our") at 1916 Old Cuthbert Rd, Unit A10, Cherry Hill, NJ 08034, United States. By using our website, submitting a booking request, or purchasing studio time or related services, you agree to these Terms. If you do not agree, do not use our services.

Services

We provide podcast studio rental, recording-related services, and add-ons as described on our website and at the time of booking. Descriptions, equipment lists, and pricing are subject to change; we will confirm material details as part of the booking or checkout process where applicable.

Bookings and accounts

When you book a session, you agree to provide accurate, current information. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. We reserve the right to refuse or cancel bookings that appear fraudulent, abusive, or inconsistent with our policies.

Payment

Fees are as quoted at checkout or as otherwise agreed in writing. Payments are processed by third-party payment processors. You authorize us and our payment partners to charge your selected payment method for the amounts due. You are responsible for any taxes applicable to your purchase, where required by law.

Studio use and conduct

You agree to:

• Use the studio and equipment responsibly and only for lawful purposes
• Follow our staff instructions and posted safety or operational guidelines
• Arrive on time; late arrival may reduce your reserved session length without a price adjustment
• Not damage equipment or premises; you may be charged for repair or replacement due to negligence or misuse

Intellectual property

Content on our website (text, graphics, logos, and design) is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, modify, or distribute our site content without prior written permission, except as allowed by law or for personal, non-commercial use that does not harm our rights.

Recordings and materials you create during your session generally belong to you, subject to any separate agreement or third-party rights in content you bring (for example, licensed music).

Disclaimer of warranties

Our services and website are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement except where such disclaimers are not permitted by applicable law.

Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of our services or website. Our total liability for any claim arising out of or relating to these Terms or our services is limited to the amount you paid us for the specific booking or service giving rise to the claim during the twelve (12) months before the claim, or one hundred U.S. dollars (USD $100) if greater, except where such limitations are prohibited by law.

Indemnity

You agree to indemnify and hold harmless The Podcast Pad and its owners, employees, and contractors from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the studio, your content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. You agree that courts located in New Jersey have exclusive jurisdiction over disputes arising from these Terms or our services, subject to mandatory consumer protections in your jurisdiction where applicable.

Changes

We may modify these Terms at any time. The "Last updated" date at the top of this page will reflect revisions. Material changes may be communicated through the website or by email where appropriate. Your continued use after changes constitutes acceptance of the updated Terms, where permitted by law.
